NY Man Sues Donald Trump For $1 Billion For 'Severe Emotional Distress'

Citing "severe emotional distress" over the campaign that resulted in the election of Donald Trump  a New York State man is suing the real estate magnate and former reality TV star for $1 billion, according to a filing Monday in federal court in Manhattan.

Louis Tafuto of Warwick in Orange County, who also cited a feeling of "powerlessness," is seeking a jury trial and is also suing Trump's running mate, Indiana Gov. Mike Pence, and Republican Party Chairman Reince Priebus.

"Donald John Trump's words and actions have proven him wholly untruthful and therefore unqualified and incapable of taking an oath of office or honoring and international treaty as President of the United States," the filing said.

The 25-page complaint was filed Monday, a day before Tuesday's election in which Trump, who owns an estate in Bedford, N.Y., surpassed the needed 270 electoral votes need to win despite losing the popular vote to Democrat Hillary Clinton.

Tafuto is also asking for an order of protection "against the defendants from making further false statements that incite violence, revolt, assassination, or insurrection."

"Donald John Trump's words and actions have proven he does not have the temperament, knowledge, or political belief to adhere to the principles of the US Constitution," the suit says.

The complaint also accuses Trump of violating the First Amendment's freedom of religion over statements he made about Muslims during the campaign.
