The unnamed man had noticed a driver swerving across the road while southbound on the Merritt Parkway Thursday night. He followed her as she took Exit 37 and was able to stop her on Stephen Mather Road around 8 p.m. and called police.
When police arrived they noticed there was front end damage to the 2014 Nissan Altima and that there was an odor of alcohol from the woman. She told police she had hit a deer and that she had one glass of wine at work.
Police checked with State Police who didn't have any reports of accidents and also discovered a soda can that was filled with wine, police said. The woman was asked to perform field sobriety tests outside her vehicle which she failed.
They took her back to police headquarters and she allegedly recorded a blood alcohol reading of .34 at 9:20 p.m. and then a second BAC reading at 9:40 which came back as .33. The legal limit is .08.
